  1. General Terms & Conditions

1.1 This website is operated and owned by; MagniTech (UK) Ltd. 18 South Street, Manningtree, Essex, England, CO11 1BB.

1.2 The business relationship between MagniTech (UK)Ltd and the purchaser is governed by UK law and, in addition, this version of our Terms and Conditions (GTC) that are in effect at the time of purchase. MagniTech (UK) Ltd does not accept any deviations of the purchaser from the General Terms and Conditions unless they have approved them in writing.

By using the MagniTech (UK) Ltd website, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use this website to source product(s).

1.3 To use our website you must have a unique email address. You agree that the e-mail address you supply can be used as a means of general communication, and you agree all notices made via email satisfy any legal requirements that such notices be made in writing.

1.4 In order to use MagniTech (UK) Ltd website and the services offered you must be over the age of 18 years old or have gained prior consent from your parent or guardian to use our website under adult supervision.

1.5 Any special quotations request and are given by the Company/purchaser on condition that the Company shall not be bound until it has communicated its written acceptance of the customer order.

1.5 It is your responsibility to ensure that you can receive emails from MagniTech (UK) Ltd. We recommend that you ensure the email address enquiry@magni-tech.co.uk is added to your 'Safe Senders' list and is not blocked by any email or computer security software. You will receive important order updates from this email address.

1.6 You agree that all details you have provided to MagniTech (UK) Ltd for the purpose of ordering or purchasing goods and services are correct to the best of your knowledge. You agree that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of goods or services ordered.

1.7 All the information you provide during your online order and transaction will be treated securely and in accordance with the Data Protection Act 2018.

1.8 The Company shall not be liable for any shortages unless notification is received by the Company in writing within 3 days of delivery. The Company shall not be liable for any defect in the goods, defect materials or workmanship discovered within one week of the date of delivery and which are notified to the Company within 3 days of the date the customer discovered the defect or ought reasonably to have discovered the defect.

1.9 Once you have entered an online order with MagniTech (UK) Ltd and have clicked the 'PLACE ORDER' button, you agree to these terms and conditions. By completing and submitting the electronic order form, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.

1.10 MagniTech (UK) Ltd reserves the right to alter or amend these terms & conditions at any time.

1.11 All goods remain the property of MagniTech (UK) Ltd until payment in full is received.

1.12 These Terms & Conditions supersede all other previous Terms & Conditions.

 

  1. Processing Orders

2.1 All prices exclude the current statutory UK VAT of 20.00%. All customers and businesses within the EU (except the Republic of Ireland) will be charged 0% VAT on orders and will be responsible for arranging payment of duties and VAT applicable in your country before delivery. For shipments outside of the EU, VAT will not apply. All customers and businesses in the Republic of Ireland will be charged the VAT applicable in ROI.

2.2 MagniTech (UK) Ltd requires £10.00 minimum spend value excluding carriage.

2.3 To complete your order with MagniTech (UK)Ltd you will need to make full payment.

2.4 Stated delivery times are approximate. Your order will be dispatched to the address provided by you during the order process and will be stated our order confirmation email.

 

3 Delivery

3.1 The Company will use reasonable endeavours to deliver by any estimated date, but time is not the essence, and the Company shall incur no liability whatsoever for failure to deliver by such date.

3.2 Any failure or defect in any one delivery shall not entitle the customer to refuse acceptance of further deliveries under the same or any other contract.

3.3 Delivery shall be deemed to take place when the goods are delivered to the customer at the Company's premises or if despatched to the Customer then immediately prior to being loaded on transport for despatch to the customer whether the transport is arranged by the Company a customer or a third party.

Delivery couriers such as DPD and/or MagniTech (UK) Ltd own fleet of vehicles may deliver your order.

Rates will vary depending on the time scale requested and the relevant cost .Ie Next day am will be charged at a higher rate than a General Next Day or 2 day delivery service

 

  1. Cancellations & Returns

4.1 Once your order is placed it cannot be cancelled. Goods can only be returned under strict circumstance and the following rules apply;

4.2 To return part/all of your you must seek authority from MagniTech (UK) Ltd by phone or email first and as per terms in clause 1.8 and 5.1

4.3 Goods not fit for resale because of any damage these will not be accepted or credited.

4.4 Goods can be returned and will be collected once agreed by MagniTech (UK) Ltd however the cost of delivery will not be refunded against the original invoice this will include any additional charges for premium delivery services

4.5 Returned magnets may be subject to a 25% restocking fee, so a refund may only be 75% of the original price paid. 

 

  1. Liability:

5.1 The Company shall not be liable for any shortages unless notification is received by the Company in writing within 3 days of delivery. See 1.8

5.2 The Company shall not be liable for any defect in the goods save defects materials or workmanship discovered within one week of the date of delivery and which are notified to the Company within 3 days of the date the customer discovered the defect or to have reasonably have discovered the defect and  PROVIDED ALWAYS that following notification to the Company the customer thereafter fully complies with all reasonable requirements of the Company relating to the use or storage of the goods and the Company's access to them.

5.3 The Company shall not be liable for loss of profit interest paid or payable by the customer, loss of orders or expense consequent upon destruction of business or any other consequential loss.

5.4 Without prejudice to any other condition if the Company shall be liable to the customer for any loss or damage such liability shall be limited to the invoice price of the goods concerned.

5.5 All quotations specifications information representations written, or forecasts of performance however given are approximate only and do not form part of the contract and the Company shall have no liability in respect thereof and the Customer acknowledges that he has not relied upon any such representation.

5.6 The Company shall have no liability in respect of any failure or delay in fulfilling its obligations to the extent that fulfilment thereof is prevented, frustrated, impeded, delayed or rendered uneconomic due to any cause beyond the reasonable control of the Company.

5.7 MagniTech (UK)Ltd takes no responsibility for damage and injuries caused by improper or careless use of its magnets.

 

  1. Personal Data

6.1 Except as expressly set out in these terms and conditions, all use of your personal information and data will be made in accordance with our Privacy Policy

6.2 Online payments are made through PayIt (Natwest). MagniTech (UK) Ltd does not handle or store any customer Credit Card details.

6.3 Orders taken over the telephone are processed directly into our payment terminal and not stored.

 

  1. Health & Safety 

7.1 MagniTech (UK) Ltd takes no responsibility for any personal injury occurred while using our magnets.

7.2 Our magnets are supplied with detailed warning sheets explaining the dangers of large or small magnets. It is your responsibility to ensure that magnets are kept away from children and that a full risk assessment is carried out before using large, high-power magnets.
